
General Terms and Conditions
1. Subject Matter of the Contract & Scope of Application
a) These General Terms and Conditions apply to the rental of the vacation home “Zur alten Schreiner” located at Eibseestraße 41 in Grainau, as well as to all services provided by the landlord in connection with the rental.
b) The vacation home is rented exclusively for vacation purposes and may only be occupied by the maximum number of persons specified in the rental agreement (12 persons).
c) Prices include taxes valid at the time the contract is concluded. The visitor’s tax is calculated separately and paid by the landlord to the municipality.
2. Booking, Rental Price & Payment Terms
a) A rental agreement is concluded as soon as the landlord has confirmed a booking request in writing.
b) A deposit of 20–30% of the total price is due upon confirmation of the booking.
c) The balance must be paid no later than 14–21 days prior to arrival.
d) If payment is not made on time despite a reminder, the landlord is entitled to withdraw from the contract and claim damages.
3. Security Deposit
If a security deposit is agreed upon, it must be paid no later than upon key handover. The deposit will be refunded after the property has been properly returned. No interest is paid on the deposit.
4. Rental Period & Check-in
a) The vacation home is available to the guest from 3:00 p.m. on the day of arrival. The landlord must be notified in the event of a late arrival.
b) On the day of departure, the property must be vacated by 10:00 a.m. and left in a clean and tidy condition.
c) The guest is requested to report any defects or missing inventory within 24 hours of arrival.
5. Withdrawal / Cancellation by the Tenant
a) Cancellations must be made in writing.
b) Standard cancellation terms (adjustable):
Up to 6 weeks before arrival: free of charge
From 6 weeks prior to the day of arrival / No-show: 90% of the rental price
c) The guest may provide a replacement tenant, provided that the replacement appears reliable.
d) The landlord will endeavor to re-rent the accommodation; any income generated will be credited.
6. Termination by the Landlord
The landlord may terminate the contract for cause under the following circumstances:

material breach of contract
-
violation of the house rules
-
delayed payment despite a reminder
In these cases, the tenant is liable for expenses incurred and lost profits.
7. Force Majeure
In the event of unforeseeable circumstances (e.g., natural disasters, government measures) that render use of the property impossible, either party may withdraw from the contract. Any payments already received will be refunded.
8. Tenant’s Obligations
a) The vacation home and its contents must be treated with care. Any damage must be reported immediately.
b) The tenant is liable for any damage caused by the tenant, fellow travelers, or visitors.
c) Waste, hygiene products, oils, food scraps, and similar items must not be disposed of in the toilet or drain.
d) In the event of technical malfunctions, the guest is obligated to take reasonable measures to mitigate damage.
e) The maximum occupancy of 12 people must not be exceeded; otherwise, the agreement may be terminated without notice.
9. Landlord’s Liability
a) The landlord is liable for the proper provision of the accommodation as described.
b) The landlord is not liable for:

slight negligence
-
power, internet, or water outages
-
force majeure
loss of personal belongings
c) The guest is personally responsible for their valuables.
10. Pets
Pets are permitted only by prior arrangement. The guest is liable for all damage caused by animals. If agreed upon, an additional fee may be charged.
11. Other Rules
a) The vacation home is a non-smoking property. Smoking is permitted only outdoors.
b) Guests must be considerate of neighbors; in particular, quiet hours from 10:00 PM to 7:00 AM must be observed.
c) Parties, loud celebrations, or similar events are not permitted unless expressly agreed upon.
12. Written Form
Any amendments to this contract or ancillary agreements must be made in writing.
13. Governing Law & Jurisdiction
a) This contract is governed by German law.
b) The place of jurisdiction is the lessor’s place of residence.
c) Should any provision of this contract be invalid, the remaining provisions shall remain unaffected.
